For October 2026, USCIS will use the Dates for Filing chart for both family-sponsored and employment-based preference categories.

Family-based categories. F2A remains current for Dates for Filing, while the Final Action Date advanced from August 22, 2026, to September 22, 2026. The F2B category shows no movement this month, with the Dates for Filing holding at September 1, 2019, and the Final Action Date unchanged at August 22, 2019.

Employment-based categories. October brings significant retrogression in the employment-based categories. EB-2 is no longer current: the Dates for Filing retrogressed to March 15, 2026, and the Final Action Date retrogressed to January 1, 2025. EB-3 (Skilled Workers and Professionals) also retrogressed, with the Dates for Filing moving from current to August 1, 2024, and the Final Action Date moving back from September 1, 2024, to May 15, 2024. The Other Workers category retrogressed as well, with the Dates for Filing moving from August 1, 2022, to June 1, 2022, and the Final Action Date moving from April 1, 2022, to January 1, 2022.

Because USCIS is using Dates for Filing for employment-based categories this month, applicants whose priority dates fall before the new filing dates may still be able to submit adjustment of status applications. Applicants should review their priority date carefully and confirm eligibility before filing.
