The Most Common Questions (FAQ)
The EB-2 is the second preference employment-based immigrant visa category, and it can lead to permanent residence in the United States, meaning a green card. It covers professionals who hold an advanced degree, or a bachelor's degree plus five years of progressive experience in their field, and individuals with exceptional ability in the sciences, arts, or business.
There are two routes. Advanced degree: a U.S. master's degree or higher, a foreign equivalent, or a bachelor's degree plus at least five years of progressive experience in your specialty after that degree. Exceptional ability: expertise in the sciences, arts, or business, shown by meeting at least three of six USCIS criteria. Most EB-2 cases also need a U.S. job offer and PERM labor certification unless you qualify for a National Interest Waiver.
PERM labor certification is Department of Labor approval that a sponsoring employer obtains before filing an EB-2 petition, so the EB-2 PERM route requires an employer. It shows there are not enough able, willing, qualified, and available U.S. workers for the job, and that hiring you will not harm U.S. wages or working conditions. National Interest Waiver self-petitioners do not need PERM, and Schedule A occupations such as nurses and physical therapists are exempt.
A National Interest Waiver lets an EB-2 applicant apply for a green card without employer sponsorship or the PERM labor certification process by showing that their work makes a significant contribution to the national interest of the United States. NIW applicants self-petition by filing Form I-140 with the waiver request, and they must still meet the EB-2 advanced degree or exceptional ability requirement.
You must meet a three-part National Interest Waiver test: your proposed work has substantial merit and national importance, you are well positioned to advance it, and on balance it benefits the United States to waive the job offer and labor certification. This is the Matter of Dhanasar standard. You must also qualify for EB-2 on your own, through an advanced degree or exceptional ability.
It depends on the route and on visa availability for your country of birth. Employer-sponsored cases begin with PERM, where Department of Labor analyst review of filed applications averaged 336 calendar days for cases decided in August 2026, then Form I-140 and the green card step. NIW cases skip PERM: standard I-140 NIW processing was about 29 months as of August 2026, and NIW premium processing commits USCIS to act within 45 business days.
