On September 18, 2026, President Trump issued a proclamation extending restrictions on the entry of certain H-1B workers and continuing a $100,000 payment requirement for covered H-1B applications, subject to national-interest exceptions.

Two different costs

This $100,000 requirement is separate from the proposed $103,265 fee for certain cap-subject H-1B petitions. The proclamation is already in effect, while the $103,265 fee is still a proposed rule.

What employers and H-1B workers should do

Employers and H-1B workers should carefully determine which requirements apply to a particular petition or travel situation, and whether a national-interest exception may be available.

Before filing or traveling, confirm whether the petition or entry is covered by the proclamation, the proposed fee, or both.
