DOL Suspends Enforcement of 2024 H-2A Farmworker Rule

The U.S. Department of Labor (DOL) has announced that it will not enforce the 2024 “Farmworker Protection Rule” for now. This rule was meant to bring new protections for H-2A agricultural workers, but it caused confusion due to several court cases and legal challenges. As a result, the DOL has decided to officially pause enforcement to give farmers and employers more clarity while legal issues are sorted out. If you’re an employer using the H-2A program, you do not have to follow the 2024 rule at this time. However, all previous H-2A rules still apply and will continue to be enforced.
