Previously, many categories—such as asylum applicants (C)(8), TPS beneficiaries, certain adjustment applicants (C)(9), refugees, asylees, and some employment-based categories—received up to a 180-day automatic extension while their renewal was pending. Under the new policy, most of these automatic extensions will no longer apply, except for categories where extensions are required by law (such as certain TPS-related documents) or specified in a future Federal Register notice.
USCIS is urging applicants to file EAD renewal requests as early as possible, ideally up to 180 days before expiration, since they will no longer be protected by an automatic extension during processing. This change may result in temporary lapses in work authorization for individuals who do not renew in time. Applicants should confirm whether their category is one of the limited exceptions still eligible for automatic extension or whether they must now plan for potential gaps.
