USCIS Moves Toward Mandatory Online Filing

USCIS has issued a new interim final rule that allows the agency to require electronic filing for certain immigration forms. The rule became effective on August 11, 2026.
How a form becomes e-file only
Under the new rule, USCIS can require online filing for a form once that form has been available for electronic filing for at least 180 days. Before making e-filing mandatory for a specific form, USCIS will generally provide at least 60 days notice on its website.
What applicants will need
Applicants will generally need to use a USCIS online account to submit the form electronically. That can mean either completing the form online or, where the option is available, uploading the completed form together with supporting evidence.
If online filing is not possible for you
The rule also provides a process for requesting a waiver when electronic filing would cause undue hardship. USCIS has discretion over whether to approve the waiver, so a waiver request is not a guaranteed alternative.
What this does not mean
Importantly, this does not mean that every USCIS form must now be filed electronically. Mandatory e-filing will apply to specific forms only after USCIS announces that requirement for that form.
The rule is a framework, not a switch. No form becomes electronic only until USCIS names it and gives notice.
